JUDGMENT / ORDER

Out of the wed-lock between the petitioner and the respondent, a female child was born, and the child is in the custody of the petitioner-wife. It is stated that the petitioner is now residing with her parents in Salem. She had filed M.C.No.54 of 2014 before the Family Court, Salem and the respondent-husband had filed I.D.O.P.No.38 of 2015 before the Principal District Court, Thiruvallur. It is the grievance of the petitioner-wife that it is very difficult for her to travel from Salem to Thiruvallur, along with the child. She is unable to meet out the expenses for every hearing to Thiruvallur from Salem. Hence, she prays for transferring I.D.O.P.No.38 of 2015 from Thiruvallur District Court to Salem District Court. Inspite of notice having been served on the respondent and his name also having been printed in the cause list, there is no representation for the respondent either in person or through counsel. Taking into consideration the grievances expressed by the petitioner and that in Transfer cases, the convenience of the wife has to be given importance, the Tr.C.M.P. is ordered and I.D.O.P.No.38 of 2015 shall stand withdrawn from the file of the Principal District Court, Thiruvallur and shall stand transferred to the Principal District Court, Salem. No costs. The Miscellaneous Petition is closed.
