E. in Ramaiah Institute of Technology / R-2 and allow this writ petition and etc.
The Writ Petition No.334/2019 coming on for Orders and remaining Writ Petitions coming on for Preliminary Hearing in ‘B’ Group this day, the Court made the following:
ORDER The subject matter of these writ petitions relates to the claim of the petitioner students for change over to other Branch of the study course. The claim having been favoured by the respondent No.2- the College, respondent No.1- University needs to take a call in the matter. Respondent - University for having not taken any decision on the said claim, petitioners have approached this Court seeking a Writ of Mandamus to compel the consideration thereof.
2. Regard being had to nature of the case and the materials placed on record, in all these matters, an interim relief was granted to the petitioners permitting them to attend the class of their intended course in change, subject to outcome of the writ petitions.
3. Learned Panel Counsel for respondent No.1- University has filed a memo dated 28.01.2019 along with the document granting redressal to the grievance of the petitioners herein. In the said memo, respondent No.1- University has sought for disposal off these cases as having become infructuous.
The said memo reads as under:
“1. The undersigned advocate for respondent No.1/University humbly submits that petitioners grievances in the following writ petitions from Sl.No.1 to 22 has been appropriately addressed by the respondent No.1/University and the petitioners have been granted substantial relief which they have sought in the writ petitions.
2. The respondent University after considering the petitioners and respective college request for change of branch, the approval for change of branch from present branch to change of branch one sought in the following writ petitions from Sl.No.1 to 22 for the academic year 2018-2019 has been accorded to the petitioners and to whom incidental benefits would accrue. A copy of communication dated 18.01.2019 made by respondent University to the undersigned advocate permitting the petitioners in following writ petitions from Sl.No.1 to 22 is herewith produced as Annexure-A.
WHEREFORE, it is humbly prayed that this Hon’ble Court may be kindly be pleased to take this memo on record and dispose of the following writ petitions from Sl.No.1 to 22 as having become infructuous in the interest of justice and equity.
In view of the above, these writ petitions are disposed off as having become infructuous.
