1. It appears that in pursuance of proceedings under Section 6- H(1) instituted against respondent no.3 - Executive Officer, Town Area Committee, Devrania, Tehsil- Bahedi, District- Bareilly, a recovery certificate for Rs. 8,55,700/- has been issued on 21.05.2018 by the Deputy Labour Commissioner, Bareilly Region, Bareilly. The recovery proceedings have been initiated for the benefit of the petitioner who is seeking execution of award against respondent no.3.
2. The petitioner is thus aggrieved by the fact that the recovery proceeding has yet not been concluded though sufficient time has elapsed.
3. Considering the fact that the Town Area Committee is a public body, it is difficult to contemplate the reasons why recovery proceedings have remained pending for so long and why the petitioner has been made to wait for his legal dues.
4. No useful purpose would be served in keeping the present writ petition pending any further, it is disposed of with a direction to respondent no.2 to ensure to take all steps and measures such that the recovery proceedings are taken at their logical end in a time bound manner such that the recovery certificate stands executed within a period of three months from the date of production of a certified copy of this order, if there is no other legal impediment.
