The petitioner herein preferred O.P.(HMA) No.1033/12, which is now pending for consideration in the Family court, Kollam, and the petitioner approached this Court by filing the present petition under Article 227 of the Constitution of India with a prayer to direct the Family court, Kollam to dispose of O.P.(HMA) No.1033/12 forthwith.
2. When the above case has came up for consideration, we have directed the Registry to obtain a report from the Family court, Kollam, about the arrears of cases in the said court. Accordingly, it is reported by the learned Judge of the Family court, Kollam, that about 4,000 cases are pending in that court for disposal. Having O.P.(F.C.)No.155 of 2014 2 regard to the said fact, we are of the view that, this Court will not be justified in directing the court below to give preference to the O.P. filed by the petitioner herein overlooking the seniority of the other cases pending in that court. So, we are not inclined to issue any direction as sought for.
3. However, the learned counsel for the petitioner submitted that the case pending before the court below was scheduled for trial ; but it has been adjourned at the instance of the respondent. In the report of the Family court, nothing has been stated about the trial or present position of this case. However, we have no hesitation to observe that if the above case has already scheduled for trial, the learned Judge of the Family court, Kollam, will see that the trial is not postponed unnecessarily and take steps to dispose the same as per the schedule.
