JUDGMENT / ORDER

The petitioner is the accused No.1 in C.C.No.788/2014 on the file of the Judicial First Class Magistrate Court-II, Aluva alleging offences under Sec.20(b)(ii)A of the N.D.P.S Act. The petitioner has completed his B.Tech course in Electronics and Communications from the Cochin University of Science and Technology and he has secured an employment abroad, it is averred. The petitioner claims that he is innocent of the allegations levelled against him. It is averred that summons was issued against CW1 & CW2 and the case was posted to 17.12.2014 and due to the pendency of the above case, the petitioner is unable to finalise his future plans and unable to go abroad to joint his employment. It is in the conspectus of these facts and circumstances, the petitioner has filed this Crl.M.C seeking invocation of the inherent powers conferred on this court as per Sec.482 Cr.P.C with the prayer to direct the Judicial First Class Magistrate Court-II, Aluva to dispose of C.C.No.788/2014 pending before it within a time frame to be fixed by this Court.

2. When the matter was taken up for consideration on 7.11.2014, this Court ordered to call for a report from the trial court regarding the minimum time required for disposal of the case.

Pursuant to the above said direction, the Judicial First Class Magistrate Court-II, Aluva has submitted a report dated 17.11.2014 informing the Registrar of this Court that the above said calender case C.C.No.788/2014 is presently in the stage of summoning of witnesses and there are only three witnesses and summons has been ordered against all the three witnesses for their appearance on 17.12.2014. As all the witnesses are official witnesses,it is pointed out that if witnesses come on that date, and if all the accused are present for identification and defence, do not seek any adjournments, the entire trial can be completed within a maximum period of three months from 17.12.2014.
4. Smt.Mereena Joseph, learned counsel for the petitioner, submits that the petitioner will not seek any unnecessary adjournment in this case and it is ensured that the trial is completed without any further delay.

In the light of these facts and circumstances, it is ordered in the interest of justice that the Judicial First Class Magistrate Court-II, Aluva will take all reasonable measures to ensure that C.C.No.788/2014 is finally disposed of without further delay and to ensure that the case is finally disposed of well before 30.4.2015.
With these observations and directions the O.P(Crl) stands finally disposed of.
