Heard Shri Kailash Nath Singh, learned counsel for the petitioner, the learned Standing Counsel and perused the record.
At the outset learned counsel for the petitioner seeks permission of the Court to amend the prayer clause of the writ petition by inserting a new prayer i.e. (ii) A with respect to early disposal of the revision pending before the respondent no.1.
Learned Standing Counsel has no objection to the prayer made by learned counsel for the petitioner.
Prayer as made by learned counsel for the petitioner is allowed. He is permitted to amend the prayer clause during course of the day.
Present petition has been filed for early disposal of Revision dated 17.12.1998, filed by the present petitioner, pending in the Court of Deputy Director of Consolidation, Jaunpur (Respondent no.1).
It is submitted by the learned counsel for the petitioner that against the order dated 28.07.1998 passed by the Settlement Officer of Consolidation, Lahuri (father of the petitioner) has preferred Revision dated 17.12.1998 which is pending protracted and till date no fruitful steps have been taken by the authority concerned to decide the same. It is further submitted that record of the Assistant Consolidation Officer is missing, therefore, the D.D.C. has passed the order dated 05.09.2018 and 31.01.2020 for reconstruction of the said record but till date neither the record has been reconstructed in pursuance of the order of the D.D.C. nor the revision has been decided.
Learned Standing Counsel has fairly contended that he has no objection if this Court issue a direction for early disposal of the above revision.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally disposed of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to the Deputy Director of Consolidation, Jaunpur (respondent no. 1) before whom the above revision is pending disposal, to decide the same expeditiously, preferably, within a period of twelve months from the date of receipt of copy of this order.
It is expected that the Deputy Director of Consolidation, Jaunpur shall decide the same by means of a reasoned and speaking order, keeping in view its own orders dated 05.09.2018 and 31.01.2020, strictly in accordance with law, after affording opportunity of hearing to the parties concerned and without granting unnecessary adjournment to either of the parties.
The petitioner shall file a computer generated copy of this order downloaded from the official website of the High Court, Allahabad, supported by an affidavit, which shall be verified by the authority concerned from the website of the High Court, Allahabad.
With the aforesaid observations, the present writ petition is disposed of.
