Heard learned counsel for the applicant and the learned AGA. Perused the record.
It is contended that the applicant and two other persons are named in the FIR but the injured witnesses have identified the applicant. In their respective statements they have taken name of the applicant for causing firearm injuries to the deceased. According to the post mortem examination the deceased succumbed due to ante mortem gun shot injury.
Considering the facts and circumstances, nature and gravity of the offence, this Court does not find any good ground to grant indulgence in the instant case.
The application for bail is, accordingly, rejected.
However, learned trial court is directed to expedite the trial of the instant case and conclude the same in accordance with law by 31.12.2018, provided the applicant fully cooperates with the proceedings of the trial.
Copy of this order be transmitted to the court concerned within a fortnight.
