Heard learned counsel for the applicant and learned A. G. A. for the State.
Applicant has moved the present bail application seeking bail in Case Crime No.320 of 2015 u/s 147,148,149,307, 302 IPC PS Deoband District Saharanpur.
Learned counsel for the applicant submitted that during trial the first informant Sandeep has been examined as PW-1 who has been declared hostile. The injured witness Mahendri has also been declared hostile. Similarly PW-3 and independent witness PW-4 both have been declared hostile.
Learned AGA has opposed the bail application of the applicant, however he does not dispute the said fact.
In view of the subsequent development, prima facie, a case for bail has been made out. However, the said prima facie view of this Court will not in any manner adversely affect the case of the prosecution.
The prayer for bail is granted. The application is allowed.
Let the applicant Sonu involved in the aforesaid case crime number be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
However, it is being made clear that this order will not be given effect to if the trial has already been concluded.
