Heard Sri Mohammad Zakir, learned counsel for the applicant, Sri Shyam Babu Vaish, learned counsel for the complainant and Sri Yogeshwar Rai, learned A.G.A. appearing for the State.
This bail application moved on behalf of applicant praying to enlarge him on bail in Case Crime No.106 of 2019, under Section 306, IPC, Police Station Dankaur, District Gautam Buddh Nagar.
The contention of the counsel for the applicant is that the applicant has been falsely implicated in the present case. The present bail application has been pressed solely on the ground that the applicant is languishing in jail since 07.02.2019.
Learned counsel for the complainant as well as learned AGA appearing for the State have strongly opposed the bail with the contention that the F.I.R. is quite specific and there are C.C.T.V. footage, as well as photograph's are available; that there is also a suicide note of the victim, copy of which is annexed on page no.32 of the bail application.
Looking to the aforesaid facts, no case for grant of any indulgence has been made out.
Accordingly, the application for bail is rejected at this stage.
