Heard learned counsel for the applicant, learned AGA for the State and perused the record.
Learned counsel for the applicant submitted that the applicant has been falsely implicated in the present case. He has not committed the offence. He is married person. So far as it appears that the matter of honour killing. The skeleton of deceased has been recovered after three months. There is no eye-witness of the offence and he is entitled for the bail.
Per contra, learned A.G.A. opposed the prayer for bail and submitted that there is an allegation of gang-rape. The skeleton of deceased was recovered at the pointing out of applicant and co-accused. Cloth of deceased was recovered at the pointing out of applicant. Hence, he is not entitled for bail.
Considering the submissions of learned counsel for the parties, facts of the case, nature of allegation, gravity of offence and without expressing any opinion on the merits of the case, the Court is of the opinion that it is not a fit case for bail. Hence the bail application of applicant- Sonu involved in Case Crime No. 195 of 2018, under Sections 366, 120B, 376D, 302, 201, 34 I.P.C., P.S. Sikandara, District Agra is hereby rejected at this stage.
It is directed to the trial court to decide the case expeditiously and in accordance with provision of Section 309 Cr.P.C. without granting any unnecessary adjournment, if there is no legal impediment.
A copy of this order be transmitted to the Court concerned for necessary compliance.
