Heard Sri Ram Kumar Dubey, learned counsel for the petitioners, Sri Irshad Hussain, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioners with a prayer to quash the F.I.R. dated 28.10.2018 registered as case crime no. 0576 of 2018 under sections 354B, 323, 504, 506 IPC, police station Seoraha, District Bijnor.
Learned counsel for the petitioners submits that petitioners are two real brothers and they have been falsely implicated in the present case by respondent no.3 for their harassment.
Learned A.G.A. opposed the prayer for quashing of the FIR.
Considering the submissions advanced by learned counsel for the parties and the nature of allegations, it is directed that the petitioners shall not be arrested in above mentioned case till submission of the police report under section 173(2) Cr.P.C. but they shall co-operate with the investigation of the case.
It is made clear if the petitioners harass the private respondent/victim, the aforesaid interim protection granted to them shall automatically stand discharged.
The victim shall approach the S.S.P./S.P. concerned for redressal of her grievance.
With the above direction, this petition is finally disposed of.
