Heard learned counsel for the petitioners and learned AGA for the State.
The petitioners who are accused in Case Crime No. 456 of 2021, under Sections 147, 452, 323, 354(kha), 504, 506, 427 IPC, PS Tajganj, District Agra, have filed the instant petition praying for quashing of the impugned FIR on the ground that the dispute between them related to a money transaction and it stands resolved by a mutual settlement. It is pointed out that respondent no. 3 (the first informant) had informed about the said fact by submitting an affidavit before Senior Superintendent of Police, Agra (annexure 2). The submission is that the investigating officer be directed to take the same into consideration.
Learned counsel for respondent no. 3 Sri Mahendra Tripathi does not dispute that parties have settled their dispute.
In view of the above, the instant petition is disposed of with liberty reserved in favour of the petitioners to approach Senior Superintendent of Police, Agra with a true attested copy of the instant order and written compromise, if any, along with their affidavits. Senior Superintendent of Police, Agra shall forward the documents submitted by the parties to the investigating officer for due consideration while submitting report under Section 173(2) CrPC.
The petition stands disposed of accordingly.
