JUDGMENT / ORDER

Heard learned counsel for the applicant and learned A.G.A. appearing for the State.
It is contended by the learned counsel for the applicant that the applicant is cleaner of the truck and has been named in the FIR but the complainant Om Prakash has exonerated him in his statement and witnesses Anil Sharma and Som Dutt have named the applicant but exonerated co-accused Jitendra who was owner of the truck.
Learned A.G.A. contended that there is consistent version against the applicant. He was involved in committing murder of the deceased. In the FIR the applicant was also named and he was working on the truck as cleaner.
The informant himself is the eyewitness, who has exonerated him in his statement but other witnesses have named the applicant.
Considering the allegations against the applicant with the changed version, without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sonu alias Sher Singh involved in Case Crime No. 423 of 2009 under Sections 302, 404, 120-B IPC Police Station Shahpur, District Muzaffarnagar be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
