Learned counsel for the petitioner contends that the petitioner is married to Km. Rekha D/o Ram Tahel, respondent no.2. Radiological age of Km. Rekha has bee found to be above 18 years. As per the certificates, however, she is below 18 years. Rekha has been kept in Nari Niketan, which would not be in her interest. As per the statement given by Rekha before the authorities, she apprehends fear from her mother and father. In such circumstances, custody of Rekha is required to be handed over to the petitioner, who is legally married husband, as is evidence from Annexure-5.
Issue notice to the respondent through Chief Judicial Magistrate, Balrampur.
Let Rekha Devi be produced in this court from Nari Niketan, Utraula, District Balrampur, on the next date of listing.
