Heard learned counsel for the applicant, learned AGA for the State and perused the record.
1.3 k.g. Ganja is alleged to have been recovered from the possession of the applicant, which is below the commercial quantity. There is no public witness of recovery. Considering all the facts and circumstances of the case and without expressing any opinion on the merits of the case, I find it to be a fit case for bail.
Let applicant Sonu @ Nipla Mahato involved in case crime No. 665 of 2010, under Section 8/20 N.D.P.S. Act, P.S. Kotwali Sadar, District-Maharajganj be released on bail on executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of court concerned.
