This writ petition has been filed for quashing the F.I.R. dated 03.07.2018 registered as Case Crime No. 163 of 2018, under Section 3/5A/8 of Cow Slaughter Act and under Section 11 Animal Cruelty Act, Police Station- Jahanaganj, District- Azamgarh.
In the F.I.R. in substance the allegation has been made that on 03.07.2018 at about 9: 00 a.m., police apprehended bolero vehicle bearing no. UP 50 BT 6922 in which six bovine animals were found. Nobody could be arrested on the spot.
Counsel for the petitioner submits that petitioner was not arrested on the spot. Only for transportaion of six bovine animals, present F.I.R. has been lodged against the petitioner.
In view of the fact of present case writ petition is disposed of with the direction that petitioners shall not be arrested in Case Crime No. 163 of 2018, under Section 3/5A/8 of Cow Slaughter Act and under Section 11 Animal Cruelty Act, Police Station- Jahanaganj, District- Azamgarh till the submission of report by Investigating Officer under Section 173(2) Cr.P.C.
