The prayer made in the instant petition is for issuing a writ of certiorari quashing the History Sheet No.493A, opened at police station Kithore District Meerut against the petitioner.
According to learned counsel for the petitioner, the history sheet has been wrongly opened.
Learned AGA submitted that the question as to whether history sheet has been rightly opened or not and whether it should be closed, can be decided by Senior Superintendent of Police, i.e., respondent No.2 Learned counsel for the petitioner does not dispute the same.
Accordingly, without expressing any opinion on merits, the instant petition is disposed of with liberty to the petitioner to approach respondent No.2 with a true attested copy of the instant order alongwith a detailed representation praying for closure of the history sheet and in which event, the second respondent shall decide the same by means of a speaking order within next six weeks.
