Heard Sri D.K. Srivastava, learned counsel for the petitioners and Sri N.K. Verma, learned AGA for the State and perused the record.
The relief sought in this petition is for quashing of the F.I.R. dated 18.5.2018, registered as case crime no.162 of 2018, u/s 324, 323 IPC, P.S. Haldaur, district Bijnor.
Learned counsel for the petitioners submits that there has been FIR from either sides against each other. The parties have compromised the dispute outside the Court though the police is harassing the parties. He further submits that both the offences are compoundable.
Learned AGA has admitted the fact of compromise entered into between the parties and he has no grievance if the present FIR is quashed by this Court.
Considering the submissions made by learned counsel for the parties, we do not find any ground to interfere in the matter. However, the Investigating Officer of the case is directed to look into the compromise entered into between the parties, who shall submit police report before the competent court in accordance with law.
It is further directed that the petitioners shall not be arrested in above mentioned case, till submission of the police report under section 173(2) Cr.P.C.
The S.P. Bijnor shall ensure that Investigating Officer concerned submits proper police report before the competent court.
With the aforesaid directions, this writ petition is finally disposed of.
