Heard learned counsel for the applicants and learned AGA for the State.
Present application under Section 482 Cr.P.C has been filed for quashing the notice dated 17.07.2019 as well as the entire proceedings of Complaint Case No. 537 of 2017 (Smt. Ravita Vs. Sonu Kumar @ Rajneesh and others), under Sections 12, 18, 19, 20, 21 and 22 of The Protection of Women from Domestic Violence Act, 2005 (hereinafter referred to as the Act), P.S. Sadar Bazar, District Saharanpur, pending in the court of Additional Chief Judicial Magistrate, Court No. 4, Saharanpur.
No illegality or infirmity has been pointed out by learned counsel for the applicants in the impugned notice issued by the Magistrate to appear before the court concerned. If the applicants have any objection with regard to proceedings initiated against other family members, they have remedy to file objection on the ground that the proceedings of the complaint against the other applicants i.e. relatives of the husband, may be dropped as there is no domestic relationship between them.
In view of the above, the application stands disposed of with the direction to the applicants to file objection before the Magistrate concerned.
