Heard Sri Rajesh Kumar Srivastava, learned counsel for the petitioner, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with the prayer to quash the F.I.R. dated 01.06.2021 registered as case crime no.203 of 2021 under sections 147, 307 I.P.C. and 3 (2) (5) SC/ST Act, police station Hariparwat, District Agra.
The assertion of the learned counsel for the petitioner that the name of the petitioner has come up during the course of investigation and he was not named in the FIR, is incorrect, as is evident from the bare perusal of the first information report. Any other argument of the learned counsel for the petitioner is not to be accepted for this reason only.
From a bare perusal of the FIR, it cannot be said that no cognizance offence is made out against the petitioner.
The writ petition is misconceived and is, accordingly, dismissed.
