Heard learned counsel for the applicant, learned Additional Government Advocate for the State/opposite party no.1 and perused the record with the assistance of learned counsel for the parties.
This application under Section 482 Cr.P.C. has been filed by the applicant for a direction to the court below to conclude the trial being Case No. 4226 of 2019 (State vs. Sanjeev Mauraya) arising out of Case Crime No. 19 of 2019, under Sections 376, 323, 504, 506 and 406 IPC, police station Jhangaha, district Gorakhpur as expeditiously as possible.
At the very outset learned counsel for the applicant submitted that he does not want to press this application at this stage and he may be permitted to withdraw this application with liberty to file afresh at the appropriate stage.
In view of submission made by Mr. Rajeev Kumar Singh, learned counsel for the applicant, this application under section 482 Cr.P.C. is rejected as withdrawn with liberty to file afresh at the appropriate stage with better particulars.
Office is directed to return the certified copy of the order sheet to the learned counsel for the applicant after retaining photostat copy of the same on record as per rules.
