Learned counsel for the applicant submits that applicant is a lady and is residing at Prayagraj. The applicant is an Assistant Teacher and is posted at Tehsil Soraon, District Prayagraj. She has moved an application under Section 125 Cr.P.C. before the Family Court, Prayagraj. She has also filed a case under Section 12 of Domestic Violence Act before the court of A.C.J.M, 18th Prayagraj. He further submits that husband of the applicant has also filed a divorce petition being Case No.1198 of 2019 (Garun vs. Sonam) under Section 13 of Hindu Marriage Act pending before the Principal Judge, Family Court, Jaunpur.
Issue notice to the respondent returnable at an early date.
Steps be taken within 48 hours by Registered Post A.D. Respondent may file counter affidavit within three weeks. The applicant shall have a week thereafter to file rejoinder affidavit.
List this matter on 26th November, 2021.
Considering the facts and circumstances of the case, as an interim measure, it is provided that further proceeding of Case No.1198 of 2019 (Garun vs. Sonam) under Section 13 of Hindu Marriage Act pending before the Principal Judge, Family Court, Jaunpur, shall remain stayed till the next date of listing.
