Even though the case has been called out in the revised call, no one is present for the petitioner. Sri Shamsher Bahadur Maurya learned counsel for the respondent no. 5 is present.
Learned counsel for the respondents submits that the petitioner is a subsequent allottee and, therefore, the writ petition is not maintainable in view of the judgement reported in 2016 (2) SCC 779 (Poonam vs. State of U.P. and others).
Having heard the learned counsel for the respondents and after having gone through the record of the case and the judgement reported in 2016 (2) SCC 779, the Court finds that the writ petition is not maintainable.
In view of the above, the writ petition is dismissed.
