Heard learned counsel for the petitioners and the learned standing counsel.
By means of this petition under Article 227 of the Constitution, the petitioner has challenged the order dated 04.02.2021 whereby the petitioner has moved an application for restoration against the ex parte decree in Matrimonial Case No.27 of 2018 (Smt. Sonali Gupta vs. Sunil Gupta) has come to be dismissed by the Principal Judge, Family Court.
In the considered opinion of this Court, the dismissal of the restoration application amounts to confirmation of the decree of divorce and, therefore, it is the final order appealable under Section 19 of the Family Courts Act, 1984.
In view of the above, this petition is dismissed with liberty to the petitioner to approach appropriate forum for reddressal of her grievance against the order impugned.
The certified copy of the order annexed with this petition shall be returned to the learned counsel for the petitioner within a period of one week from today after retaining photostat copy of the same.
