Heard learned counsel for the petitioners and learned AGA for the State.
This habeas corpus is being filed by petitioner no.2 Gurudutt Goshwami, father of corpus of petitioner no.1 Smt. Sonali Goshwami @ Ritu Goshwami, who is in illegal captivity of respondent no.4 Abhisth Pandey, who happens to be husband of petitioner no.1.
Submission made by the counsel that the corpus is allegedly married to respondent no.4. As per highschool certificate her date of birth is 09.08.2001 and she has voluntarily tied the nuptial knot with respondent no.4 on her own free will.
On the contrary Sri Gurudutt Goshwami, father of petitioner no.1 has lodged the FIR as case crime no. 150 of 2019 under Section 366 IPC, P.S. Linepar, District Firozabad. Learned counsel for the petitioners has submitted that the Division Bench of this Court vide it's order dated 20.09.2019 in Crl. Misc. Writ Petition No. 21614 of 2019 has protected the interest of the couple.
Under the circumstances, let S.H.O./concerned S.I. (Investigating Officer) would gear up the investigation and conclude the same within a period of two months from the date of production of certified copy of this order and submit its report under Section 173(2) Cr.P.C. before the court concerned.
With the aforesaid observation, the present habeas corpus writ petition is disposed of.
