1. Heard Mrs.Swati Soparkar, learned counsel for the petitioner as well as Mr.B.M. Mangukiya, learned counsel for the respondent-Company.
2. As per the affidavit filed by the petitioner in response to the additional affidavit filed by the respondent-Company, as per the petitioner, sum of Rs.1,42,184/- is payable as per the accounts of the petitioner.
3. Mr.Mangukiya, learned counsel has expressed that the respondent-Company desirous to settle the issue involved in the present petition and latest by 20.04.2012, the respondent-Company shall be in a position to make a definite statement before this Court as to how and when the aforesaid amount due and payable to the petitioner shall be made available to the petitioner.
4. To enable learned counsel Mr.Mangukiya to take proper instructions and make a definite statement, as a last chance, the matter is adjourned to 23.04.2012.
5. It is however, made clear that, if no such definite statement is made on behalf of the respondent-Company, the mater shall be taken up on its own merits.
