Heard learned counsel for the petitioner and Shri Suryabhan Singh, learned Standing Counsel for the respondent Nos. 1 to 5.
The petitioner is before this Court for a direction in the nature of mandamus directing the District Magistrate, Chitrakoot to send the recommendation/verification report to the Superintendent of Police, District Kaushambi in pursuance to the letter dated 6.2.2021 for the purpose to provide compassionate appointment to the petitioner and further prayer has been made to direct the Superintendent of Police, District Kaushambi to provide the compassionate appointment to the petitioner in the department of Uttar Pradesh Police.
Learned counsel for the petitioner submits that the matter relates to the compassionate appointment for which the petitioner had moved an application on 24.2.2017. While processing the said application, the Superintendent of Police, Kaushambi has already requested the District Magistrate, Chitrakoot through letter dated 6.2.2021 wherein certain information has been asked regarding the status of Case Crime No. 519 of 2012 under Section 498-A/34 IPC and Section 3/4 D.P. Act, Police Station Kotwali Karvi, District Chitrakoot. He submits that even though substantial time has been lapsed in between but till date actual verification has not been ensured by the District Magistrate, inspite of the fact that in the said criminal proceeding, amicable settlement have already taken place.
In the facts and circumstances of the case, no useful purpose would be served in keeping the writ petition pending further. The writ petition is disposed of asking the District Magistrate, Chitrakoot to send adequate information to the Superintendent of Police, Kaushambi in the light of request made by letter dated 6.2.2021 so that final decision with regard to compassionate appointment of the petitioner may be taken at the earliest.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
A copy of this order be provided to Shri Suryabhan Singh, learned Standing Counsel for sending a reminder to the District Magistrate, Chitrakoot so that requisite verification report regarding the petitioner be furnished to the Superintendent of Police, Kaushambi within two weeks for necessary compliance.
