Two interlocutory applications are pending in O.S.No. 201/2010 on the file of the Court of the Munsiff of Neyyattinkara. I.A.No. 2240/2014 has been filed by the defendant therein to dismiss the suit as infructuous. I.A.No. 2741/2014 has been filed by the plaintiff therein for amendment of the plaint. The prayer of the plaintiff to consider the interlocutory application for amendment of the plaint first before considering the interlocutory application about the maintainability of the suit is justifiable. 2. I therefore direct the Court of the Munsiff of Neyyattinkara to dispose of I.A.No. 2741/2014 in O.S. No. 201/2010 within one month. I.A.No. 2240/2014 in O.S.No. 201/2010 shall be disposed of within one month from the disposal of I.A.No. 2741/2014. I express no opinion on the merits of the interlocutory applications aforementioned to be dealt with by the court below.
