Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following amongst other reliefs:-
"(i) a writ, order or direction in the nature of mandamus directing the respondent no. 1 to decide the Appeal No. 980 (Sukhraji & others Vs. Puranwasi & others) under section 11(1) of U.P. Consolidation of Holding Act, preferred against the order dated 22.11.1991 passed by Consolidation Officer, Kushinagar, pending since 07.12.1991, expeditiously or within a stipulated period of time."
It has been stated that the appeal preferred in the year 1991 under Section 11(1) of the U.P. Consolidation of Holdings Act has not been disposed of till date.
The writ petition is disposed of directing the Settlement Officer Consolidation, Kushinagar, respondent no. 1 to decide the pending Appeal No. 980 (Sukhraji & others Vs. Puranwasi & others), positively within a period of four months from the date a certified copy of this order is filed before him.
It is also provided that in case, necessity arises, the Settlement Officer Consolidation, Kushinagar, may hear the matter on a day to day basis, so as to pass final orders within the time specified above.
