Shri Sanjay Kumar Singh, learned counsel for the petitioner submits that petitioner's husband was working as peon in educational institute and retired on 31.1.2013 and subsequently died on 17.7.2013.
The post retiral benefits was not paid to her by the State- respondents and in order to ventilate her grievances, she also filed the Writ A No.67090 of 2014, which was disposed of vide order dated 5.10.2017. The relevant part of the order is quoted hereinafter :-
"Considering the facts and circumstances of the case, this writ petition is disposed of with a direction to the respondent No.2 to decide the representation of the petitioner in accordance with law, expeditiously, preferably within eight weeks from the date of presentation of certified copy of this order along with a copy of the representation dated 9.9.2014.
In case, any amount is found legally due and payable to the petitioner, it shall be paid to the petitioner within a further period of two months.
With the aforesaid direction, the writ petition is disposed of."
In pursuance of this abovementioned order, certain amount has been granted to the petitioner, however, learned counsel for the respondents submits that still the entire benefits has not been paid and for that the petitioner has also filed the representation dated 25.3.2018 wherein the details of outstanding amount towards pensionary benefit has been narrated. The said representation is annexed as Annexure No.4 to the petition.
Learned counsel appearing on behalf of the State is directed to take instructions by way of filing an affidavit.
Put up this matter on 28.5.2019, as a fresh case, before the appropriate Bench.
