The complaint in this Original Petition is regarding the non consideration of I.A.No.378 of 2011 in A.S.No. 11 of 2011 thereby jeopardizing the right of the petitioner in the sense that he being the judgment debtor, the decree holder has taken out execution by virtue of E.P.No. 4 of 2011 in O.S.No. 313 of 2006 and he apprehends that delivery may be ordered on 27.11.2014.
2. All that this Court can at present do is to direct the lower appellate court to take up the interlocutory application and dispose it of as early as possible.
This Original Petition is disposed of with a direction to the Additional District Court, Mavelikkara to take up I.A.No. 378 of 2011 in A.S.No.11 of 2011 and dispose it of on merits as expeditiously as possible at any rate within a period of two weeks from the date of receipt of a copy of this judgment.
