~ ~ ~ ~ ~ ~ Petition filed under Section 439 Cr.P.C. 2. Petitioner is the accused in Crime No.1140/2014 of the Ezhukone Police Station registered for the offences punishable under Sections 323, 450 and 376 IPC and Section 3(1)(xi) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
3. The allegation against the petitioner is that on 20.09.2014 at 11.30 p.m., he, with the intention of committing rape on the defacto complainant, who is a 90 year old woman belongs to a Scheduled Caste, committed house trespass into her house when she was alone. He forcibly gagged her mouth by thrusting cloth into her mouth, repeatedly slapped on her cheeks, pushed her down and committed rape on her. The petitioner has been in custody BA.8254/2014 : 2 :
for the period from 22.09.2014 onwards.
4. Heard learned counsel for the petitioner and the learned Public Prosecutor.
5. The contents of the CD, prima facie, reveal the complicity of the petitioner. The investigation of this case is not over. The allegations against the petitioner are very grave and serious. A person like the petitioner cannot be permitted to roam around. Considering the seriousness of the allegations against the petitioner and the present stage of investigation, I am of the view that the petitioner is not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
