Somabhai vs State

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.

Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.

By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail on the ground that he wants to attend the marriage of his nephew scheduled on 14th April, 2012.

From jail remarks, we find that the applicant was on furlough from 5th January, 2012 to 18th January, 2012. On this count, discretion does not deserve to be exercised.

Hence, the application is rejected. Rule discharged.
