1. Despite the fact that the present Second Appeal is of the year 1978 and it is reported that respondent Nos.1/4, 1/5 and 3/1 have expired and number of opportunities have been given to bring the heirs of respondent Nos.1/4, 1/5 and 3/1 on record, no steps have been taken to bring the heirs of respondent Nos.1/4, 1/5 and 3/1 on record. Hence, the present Second Appeal is dismissed as having been abated so far as respondent Nos.1/4, 1/5 and 3/1 are concerned.
2. At the request of Mr.R.C.Jani, learned advocate appearing on behalf of the appellants and considering the fact that main Second Appeal is of the year 1978, arising out of the Suit, which was filed in the year 1959, as a last chance, S.O. to 24/04/2012.
