This transfer application under Section 24 CPC has been filed seeking transfer of a motor accident claim petition.
This Court vide judgment dated 12.11.2018 passed in a bunch of Transfer Applications, the leading case whereof was Transfer Application (Civil) No. 214 of 2017, has held that Section 24 CPC cannot be invoked for transferring a motor accident claim petition pending before the Claims Tribunal constituted under the Motor Vehicle Act.
Under the circumstances, this transfer application under Section 24 CPC is not maintainable and is dismissed as such.
