Heard learned counsel for the applicant, the learned A.G.A. and perused the record.
This bail application has been filed on behalf of the applicant involved in Case Crime No. 55 of 2017, under Sections 498A, 304B, 302/34, 107, 108 IPC and 3/4 Dowry Prohibition Act, P.S. Dauki, District Agra.
Applicant is the husband of the deceased; the deceased was married to the applicant 1-1/2 years earlier; body of the deceased was found hanging from a tree in jungle; postmortem examination report supports the prosecution version;
It is urged by learned counsel for the applicant that prosecution witnesses have turned hostile and other family members have already been enlarged on bail; applicant is also entitled to be released on bail.
Learned A.G.A. opposed the prayer for bail contending that applicant is the main accused; allegation is primarily against the applicant; it will not be in the interest of justice in case applicant is released on bail.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application at this stage.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously preferably within four months from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
