JUDGMENT / ORDER

Court No. - 49
Case :- APPLICATION U/S 482 No. - 6555 of 2018 Applicant :- Som Dutt Opposite Party :- State Of U.P. And Another Counsel for Applicant :- Rajeev Kumar Agrawal Counsel for Opposite Party :- G.A.
Hon'ble Saumitra Dayal Singh,J.
Heard learned counsel for the applicant and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to quash the proceeding under Section 82 Cr.P.C. issued on 04.01.2018 by the C.J.M., Muzaffar Nagar in respect of FIR dated 06.03.2017. While learned counsel for the applicant submits that the applicant had no knowledge of the proceedings, yet, from perusal of the affidavit in support of the application it appears that the applicant had knowledge of the co-accused having approached this Court by means of Criminal Misc. Writ Petition No. 12779 of 2017 wherein some interim protection had been granted. In any case, no material exists on record to believe the contention made by the learned counsel for the applicant that he did not have knowledge of the proceedings.
In view of the above, the present applicant lacks merit and is accordingly dismissed.
