The property belongs to the first petitioner's husband has been bought by the Government under Section 50(2) of the Revenue Recovery Act for the alleged dues towards the Kerala Toddy Workers Welfare Fund Board. The petitioners rely on the judgment of this Court in District Collector, Alappuzha v. Subaida Beevi and another (2010(1) KHC 936. Therefore, in view of the above judgment Government cannot purchase land in the name of the Government, this dues for the Toddy Workers Welfare Fund. The Toddy Workers Welfare stated that they have not received any amount from the Government.
2. In view of the dictum of this Court in Subaida Beevi's case the sale in Ext.P6 confirmation of sale is set aside. The petitioners shall remit the outstanding dues that shall be communicated to the petitioners within four weeks WP(C).No.3841/2013-E.
2 from the date of receipt of this judgment by the second respondent. Thereafter on confirmation of the payment as above, the property shall be conveyed to the petitioners at the expenses of the petitioners by the first respondent or any other competent officer authorised by him within a further period of two months.
The writ petition is disposed of as above.
