On perusal of record it has emerged that until now issues are not framed.
It has also emerged that the respondent had filed objections against the petition, which are yet not decided.
After filing objections, the respondent filed written statement.
The petitioner has raised objections against submission of written statement. The objection is raised on ground of delay.

When the respondent is asked to make submissions in connection with the application raising objections against the petition, learned counsel for respondent has requested for time to make submissions in connection with his application/objections against the maintainability of election petition.
Mr. Barot, learned advocate for petitioner in Election Petition No.5 of 2009 has submitted that he adopts the arguments made by learned Senior Counsel for the petitioner in Election Petition No.4 of 2011.
So as to enable the respondent to make submissions in connection with his application/objection against maintainability of the petition, time is granted and at the request of learned advocate for respondent and with consent of learned advocate for petitioner, S.O. to 4th December 2012 for hearing the submissions in connection with the respondent's application/objections against the petition.
