JUDGMENT / ORDER

(PER : HONOURABLE THE CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) The Appeal is admitted.
Let the original record be called for. Let the matter appear on January 7, 2013.
After hearing Mr. M.K. Shah, the learned advocate appearing on behalf of the appellants and after taking into consideration his submission that the writ-application has been dismissed on the sole ground that the same is not maintainable as Sardar Vallabhbhai National Institute of Technology is not a State within the meaning of Article 12 of the Constitution of India, we find that the appellants have made out a strong prima facie case to have an interim order to this extent that there will be an order of status-quo as on this date as regards the existing service of the appellants as daily wagers in the respondent-Institute, with liberty to apply for extension on the selfsame application. We accordingly pass such order.
Notice be served directly upon the respondents by Speed Post, to be issued by tomorrow. The appellants are also at liberty to file supplementary affidavit in support of the application.
Direct service today permitted.
