JUDGMENT / ORDER

Petitioner approached this Court on account of non conclusion of the proceedings initiated under Sec.61A of the Kerala Forest Act. According to the petitioner, case was registered in the year, 2010 and respondents failed to conclude the proceedings under Sec.61A of the Forest Act. Accordingly petitioner seeks release of the vehicle pending proceedings.
2. Learned Special Government Pleader has filed a memo.
It is stated that the vehicle is ordered to be confiscated as per order dated 04.11.2014.
3. In view of the above, petitioner has an alternate remedy by challenging the confiscation order under Sec.61D of the Forest Act before the District Court of competent jurisdiction. If petitioner files an appeal before the District Court challenging the order of confiscation, same shall be disposed of as expeditiously as possible. It is open for the petitioner to move the District Court for interim custody. If such an application is moved, the same shall be considered within a period of four weeks from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of as above.
