Solaimalai Enterprises vs The Inspector General Of Police

Madras High Court|21 October, 2009

JUDGMENT / ORDER

The petitioner is a distribution agent for the products of Procter and Gamble Home Products Limited and Procter and Gamble Hygiene and Health Care Limited. The petitioner sent a representation dated 28.07.2009 to the first respondent for taking appropriate steps including police protection for doing their free trade business in and around Coimbatore and Erode District.
2. Immediately thereafter, they filed the present writ petition seeking for the very same relief. The learned counsel for the petitioner though contended that their distribution business being disturbed by certain persons, he has not chosen to name any one of the person either in the affidavit filed in support of the writ petition or in the complaint made to the first respondent dated 28.07.2009. A perusal of the complaint do not disclose any cognizable offence against the petitioner carrying on his trade in Coimbatore and Erode District. The names of persons, the details of offence and the identity of persons who involved was also not mentioned. The grievance of the petitioner is that while the petitioner has engaged a set of load workers for loading and unloading operation, there seems to be resistance from the local workers in not employing them. This is purely a dispute between two groups of workmen, which will have to be resolved by the petitioner either by having direct talks or availing the provisions of Industrial Disputes Act.
3. This Court is not inclined to grant the relief claimed by the petitioner in the absence of there being legal and enforceable right and also no appropriate complaint being registered with the local Station House Officer giving particulars.
4. In the light of the above, the writ petition is misconceived. Accordingly, the same stands dismissed. No costs.
