JUDGMENT / ORDER

Petitioner has approached this Court inter alia seeking the following relief:
“(i) Issue a writ in the nature of mandamus or any other appropriate writ, order or direction directing the 2nd respondent to issue passport to the petitioner so as to produce before the authority concerned to appear for the examination in GP Rating Admission Test which will be conducted on 18/5/2014.”

Petitioner submits that as per the instructions issued by the authority which conducts the examination for GP Rating Admission Test which was scheduled to be conducted on 18/05/2014, the candidate should produce the passport in original for identification which is evident from Ext.P5. The examination is now adjourned to 31/05/2014. According to the petitioner, in order to write the aforesaid examination, he has to obtain a valid passport. Admittedly, the petitioner is involved in a few criminal cases.

3. The learned ASGI, on instructions, would submit that unless necessary permission is obtained from the Magistrate concerned, before whom the criminal cases against the petitioner are pending, the Passport Officer cannot issue passport.
Under these circumstances, I do not intend to grant the relief sought for by the petitioner. However, this writ petition is disposed of as under:
The petitioner shall be at liberty to approach the learned Magistrate before whom the criminal cases against him are pending and seek for No Objection Certificate for issuance of passport and if such NOC is obtained, the same shall be produced along with the application for issuance of passport before the 2nd respondent, who shall thereafter verify the same and pass appropriate orders.
