1. Petitioners are shareholders of the third respondent company. They challenge Ext.P11 order passed by the first respondent. Ext.P11 order passed by the first respondent relates to transfer of an extent of 3.105 acres of land in Sy.No.96/5 Part 133/2 of Kadungallur village to the fourth respondent. In fact, originally, this land was allotted in favour of the third respondent who was unable to carry out any activity in the said area allotted to them. Petitioners, who are shareholders, challenges the above order of the first respondent.
2. Primarily, petitioners who are shareholders of the third respondent cannot independently challenge any orders of the first respondent. They have no locus standi to challenge the decision of the first respondent, in so far as the first respondent had taken a decision in exercise of powers conferred on him. The third respondent alone has W.P.(C)No.3955/2014 -:2:-
the right to challenge the said order. Since they no objection, the shareholders cannot claim any independent right. Writ petition is accordingly dismissed.
