Notice need not be issued to the private respondents in view of the order proposed to be passed.
Petitioner before this Court is assailing the validity of order dated 30.05.2005 passed by third respondent in Case no.127/2000 under Section 198(4) of UPZA&LR Act, 1950 (Ram Nath vs. Gaon Sabha and others) as well as order dated 31.01.2011 passed by second respondent in Revision no.12938 of 2008 (Sohan and others vs. Gaon Sabha and others).
At the very outset, learned Standing Counsel as well as Shri Diwakar Singh, Advocate raised a preliminary objection that the present writ petition has been filed with the delay and laches and the same is liable to be dismissed on this ground alone.
On such an objection, this Court has proceeded to consider the report submitted by the Stamp Reporter wherein it has been mentioned that the present writ petition has been filed with the delay of 6 years 143 days. This Court has also perused the record in question and the same does not contain any plausible reason for the delay and laches, in view of this, the writ petition cannot be entertained by this Court and the same is dismissed on the ground of delay and laches.
