Heard learned counsel for the petitioner and Shri Devesh Vikram, learned Standing Counsel for the respondents.
By means of present writ petition the petitioner has challenged the impugned order dated 20.9.2018 passed by the fourth respondent, District Supply Officer, Meerut by which he has suspended the fair price shop licence of the petitioner.
Learned counsel for the petitioner apprises to the Court that after filing of the present writ petition the fair price shop licence of the petitioner has also been cancelled on 5.1.2019.
Learned Standing Counsel has raised a preliminary objection regarding maintainability of the present writ petition on the ground that against the cancellation order the petitioner has got efficacious alternative remedy of filing an appeal before the Commissioner of the Division.
In view of above, the writ petition is disposed of with observation that if the petitioner files an appeal against the cancellation order alongwith the stay application within 10 days' from today, the Appellate Authority will decide the stay application filed alongwith the appeal within next three weeks. The appeal may also be decided expeditiously.
