Heard learned counsel for the petitioner.
In view of the order proposed to be passed in the present writ petition, notice to respondent Nos.2 to 4 is dispensed with.
The grievance of the petitioner is that the respondent No.2 filed Suit No.2882 of 2016 for partition and permanent injunction, wherein the petitioner appeared on 30.05.2017 and filed written statement enclosing the relevant documents to establish his case before the respondent No.1. The property in question belongs to the petitioner and the daughter-in-laws of the petitioner are interfering in the possession of the petitioner with the help of local police due to pendency of the suit referred herein above.
Learned counsel for the petitioner submitted that the respondent No.2 deliberately impleaded the other daughter-in-laws in the array of parties and the plaintiff is delaying the disposal of the suit by seeking unnecessary adjournments in the matter and is not interested in early disposal of the aforesaid suit.
Further submission of learned counsel for the petitioner is that in case the hearing of the suit is expedited and direction is issued for early disposal of the suit, ends of justice would be met.
In view of the submission advanced by learned counsel for the petitioner, no useful purpose will be served in keeping the writ petition pending.
Accordingly, this writ petition is finally disposed of with a direction to the respondent No.1 to expedite the hearing of the suit by providing opportunity to the parties to lead their evidence with further direction not to grant unnecessary adjournments to the parties and to decide the suit within a period of one year from the date of production of a certified copy of this order.
