Heard learned counsel for the petitioners; learned AGA for respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the First Information Report dated 29th December, 2018 registered as Case Crime No.1467 of 2018, under Sections 363 and 366 IPC at Police Station Kotwali Nagar, District Etah.
The impugned First Information Report alleges that informant's minor daughter Km. Neha aged about 17 years has been enticed away by neighbours of the informant who have all been named in the First Information Report.
The case of the petitioners is that the victim, daughter of the informant, has been enticed away by son of the petitioner no.4 and the petitioners, who have no role, are being unnecessarily harassed.
As it is not disputed that the missing girl has not been found, no case for interference in the investigation is made out as for effective conclusion of the investigation, recovery of the missing person would be necessary for which interrogation or even taking a person on remand may be required.
In view of the above, the prayer of the petitioners to quash the First Information Report is refused.
The petition is dismissed. The petitioners are at liberty to apply for bail, if so advised.
