1. The petition seeks issuance of a writ in the nature of certiorari quashing first information report dated 19.11.2015 in Case Crime No.537 of 2015, under Sections 376, 352, 504 I.P.C., Police Station Gosaiganj, District Lucknow.
2. It has been pleaded on behalf of the petitioners that the prosecutrix respondent no.4 has solemnized marriage with Asif, the main accused. Evidence of marriage is available on record as Annexure-2.
3. Issue notice to serve respondent no.4, returnable on 16.02.2016.
4. In the meantime the Investigating Officer shall verify the genuineness of Annexure-2. In case Annexure-2 is found to be genuine, under what circumstance, it is being concluded that offence be committed.
5. Arrest of the petitioners shall remain stayed.
6. Petitioners are directed to join investigation.
7. It is made clear that in case Annexure-2 is found to be a forged document, the petitioners would be burdened with costs quantified at Rs.20,000/-.
