By the apparently final order dated 31.5.2011, this Court required and directed an inquiry to be held by the State Government through an officer not below the rank of Principal Secretary.
The impugned order annexure-1 to this writ petition, which is dated 30.6.2012 is by the District Magistrate. It does not refer to any kind of inquiry having been conducted by any officer not below the rank of Principal Secretary.
Learned counsel for the respondent no.1 and the learned counsel for the remaining respondents pray for and are granted one month's time to file a counter affidavit. List thereafter.
In the meantime, in view of what has been stated above, we direct that no coercive action shall be taken against the petitioners on the basis of the impugned order dated 30.6.2012, passed by the District Magistrate, Kanpur-Nagar (Annexure 1) and Annexure 2, till the next date of listing.
